General terms and conditions (GTC) for orders at www.sophia-malina-wild.com.
In the following we would like to introduce you to our general terms and conditions, which we use as a basis for the provision of all services provided on sophia-malina-wild.com. We offer you www.sophia-malina-wild.com tailor-made clothing tailored to your needs, wishes and dimensions.
- CONCLUSION OF CONTRACT AND DELIVERY OF GOODS
1.1 Contracts over www.sophia-malina-wild.com we close exclusively in German or English. You can select your preferred language via the language selector at the top of the website header or in the settings in your customer account. When ordering dress to measure UG articles and dresses, your contractual partner is dress to measure UG, entered in the commercial register of Germany at the Munich district court under HRB 273371, represented by the managing director Sophia Malina Wild.
1.2 By clicking the “Buy now” button, you are placing a binding order for the items in the shopping cart. We will confirm receipt of your order by e-mail immediately after sending the order. A binding contract is concluded upon receipt of the order confirmation. Please note that the delivery and production of the ordered goods takes place in advance as soon as we have received payment of the full purchase price as well as any shipping costs. We therefore ask you to transfer the purchase price immediately after receipt of the order confirmation, but no later than within 7 days.
1.3. You agree to the assignment of the claims of dress to measure UG (limited liability) for payment of the purchase price to third parties.
1.4. Please note that, as an exception, we are not obliged to deliver the goods ordered if we have properly ordered the fabrics for the manufacture of the goods on our part, but have not been supplied correctly or on time (congruent hedging transaction). A further requirement is that we are not responsible for the lack of material availability and that we have informed you of this fact immediately. In addition, we must not have taken the risk of procuring the ordered material. If the materials are not available, we will immediately reimburse you for payments already made.
1.5 We deliver orders to you within 15 working days, maximum 20 working days. The stated delivery times are working days, by which we mean all days from Monday to Friday inclusive, with the exception of public holidays.
1.6 You will be informed about the delivery time on the respective product detail page and before placing the order.
- PRICES AND SHIPPING COSTS
2.1 The prices listed in the offer at the time of the order apply. The prices quoted are final prices, which means that they include the applicable German statutory value added tax. The goods remain our property until the purchase price has been paid in full.
2.2 The shipping costs (including any return shipping) are to be borne by you.
- PAYMENT
3.1 We offer the payment methods prepayment, credit card and PayPal. Please note that we only accept payments from accounts within the European Union (EU). Any costs of a money transaction are to be borne by you.
3.2 In the case of a purchase by credit card, your credit card account will be charged upon receipt of the order confirmation.
3.3 You agree that you will only receive invoices and credit notes in electronic form.
- Promotion vouchers and their redemption
4.1 Promotional vouchers are vouchers that cannot be purchased, but that we issue as part of advertising campaigns with a certain period of validity.
4.2 Promotion vouchers can only be redeemed within the specified period and only once as part of an order process. Promotional vouchers cannot be used to purchase gift vouchers. Please note that promotional vouchers can be tied to a minimum order value.
4.3 The value of the goods must be at least equal to the amount of the campaign voucher. A difference to a higher value of the goods can be compensated with the payment options offered. The value of a campaign voucher is neither paid out in cash nor is interest paid. The campaign voucher will not be reimbursed if goods are wholly or partially returned.
4.4 Promotion vouchers can only be redeemed before completing the order process. Subsequent crediting is not possible. The campaign voucher cannot be transferred to third parties. Several campaign vouchers cannot be combined with one another unless we have agreed otherwise.
4.5 If you used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you are keeping if - due to your cancellation - the total value of the order falls below or corresponds to the value of the promotional voucher .
- GIFT CERTIFICATES AND THEIR REDEMPTION
5.1 Gift vouchers are vouchers that you can purchase. These can only be redeemed for the purchase of SOPHIA / MALINA / WILD articles, but not for the purchase of other gift vouchers. If the balance of a gift voucher is insufficient for the order, the difference can be offset with the payment options offered.
5.2 Gift vouchers can only be redeemed before completing the order process by entering the gift voucher code. The balance of a gift voucher is neither paid out in cash, nor is interest paid.
- LEGAL RIGHT OF WITHDRAWAL FOR SOPHIA / MALINA / WILD ARTICLES
First of all, we would like to inform you that in the event of a return of goods you will receive the return label from us after you have applied for a return via your customer account and for the respective article. If you do not have a printer, are having difficulties downloading the return label or need a new return label, you can request one from our Customer Care (contact details below). Please help us to avoid unnecessary costs and do not send the goods back without a return label.
RIGHT OF WITHDRAWAL:
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods or, in the case of partial deliveries, the last delivery.
In order to exercise your right of withdrawal, you must inform dress to measure UG, Corneliusstr. 15, 80469 Munich, telephone: 089 69 32 49 74, e-mail: s.wild@sophia-malina-wild.com by means of a clear statement (e.g. a letter sent by post, fax or e-mail) about your decision to revoke this contract. You can use the attached sample revocation form for this. However, this is not mandatory.
You can also electronically fill in and submit the model withdrawal form or another clear declaration using the contact form on our website.
If you make use of this option, we will send you a confirmation of receipt of your revocation immediately (e.g. by email). To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.
Consequences of the withdrawal
If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. Under no circumstances will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract.
The deadline is met if you send the goods before the period of fourteen days has expired. We will bear the costs of returning the goods if you use the return label provided by us for a return within Germany. Otherwise you have to pay the return costs.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.

Attention: The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
Attention: According to Section 312g (2) No. 1 BGB, there is no right of withdrawal for contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the consumer's personal needs.
- REPAYMENTS
We will automatically arrange any repayments to the account you used for payment. When paying in advance, the transfer back will be sent to the account from which the transfer was made. If you have paid by PayPal or credit card, the refund will be made to the associated PayPal or credit card account. If you used a gift voucher for your purchase, we will credit the corresponding amount to your gift voucher account.
- COLOR DISPLAY & CANCELLATION
8.1 dress to measure UG offers tailor-made clothing for women. On the website you will find detailed product descriptions and 3D visualizations of the products that can be purchased. While we try to display the colors of our products accurately on the website, actual colors will depend on your monitor and screen settings, and therefore we cannot guarantee that the colors displayed on your screen will accurately reflect those of the product at the time of delivery and/or receipt. Manufacturing variations, your monitor settings and computer hardware can affect fabrics and product designs, which means that the products delivered may differ slightly in appearance from those shown and described on the website.
8.2 dress to measure UG only allows cancellations or changes to measurements or fabrics if they are made within 24 hours. To do this, send us an e-mail with the respective request service@sophia-malina-wild.com. After the 24 hours have elapsed, the order can no longer be canceled because production has started and costs have been incurred (for fabrics, tailors, etc.).

dress to measure UG offers made-to-measure clothing for women. It is important to us that your dress fits perfectly. Nevertheless, small measurement errors or implementation errors can occur in individual cases. Should alterations be necessary then you can go to a tailor of your choice. dress to measure UG then takes over 10 % of the change costs.
In order to be able to claim a reimbursement of changes, you must first contact our Customer Service (service@sophia-malina-wild.com) turn around. Here we would ask you to send us photos of your dress and, if necessary, take measurements so that we can see whether the error is due to our production or not. If the tailor is able to make all changes, we would ask you to send us the invoice. After receiving the invoice, you will be reimbursed our pro rata costs within 72 hours.
In addition, the following conditions apply to the reimbursement of change costs:
- Refunds must be requested within 30 days of receiving the order.
- Costs will only be reimbursed if you prove them with a full invoice within 30 days of receiving the order.
- The reimbursement of modification costs is limited to 10% of the product price.
If the tailor is unable to make the necessary changes and the incorrect fit is based on an implementation error on our part, then you can send the dress back to us and we will make a new one for you.
The following conditions apply if you want to apply for a new production:
- The new production will always correspond to the original product.
- dress to measure UG will bear the costs of the return.
- Style and fabric changes have the following additional costs: 20 % of the price of the original product + the difference in the price of the fabric.
- The change of substance will be free of charge if the substance is no longer available.
- dress to measure UG reserves the right to refuse re-makes if our professionals believe that an adjustment from a local tailor is the most appropriate option, the products are not in perfect condition, or the customer does not match the re-made items requested information cooperates.
In any case, since the goods are individually tailored, we cannot refund the total amount of the order.
If the changes are not possible and the fit errors are based exclusively on measurement and/or input errors on your part, dress to measure UG reserves the right to refuse a new production.
- LEGAL LIABILITY AND FURTHER INFORMATION
10.1 The statutory liability for defects applies.
10.2 The use of the www.sophia-malina-wild.com Available offers is possible for people who are at least 18 years old.
10.3 Each customer is only entitled to maintain one customer account at dress to measure UG at the same time. We reserve the right to delete multiple registrations.
10.4 You can view these terms and conditions at www.sophia.malina-wild.com. You can also print out or save this document by using the usual function of your Internet service program (= browser: usually "File" "Save as"). You can also download and archive this document in PDF format by clicking here (insert link here) click. To open the PDF file, you need the free Adobe Reader program (at www.adobe.de) or comparable programs that can handle the PDF format.
10.5 You can also archive the terms and conditions as well as the data of your order by either downloading the terms and conditions and using the functions of your browser to save the data summarized on the last page of the order process in the online shop, or you can wait for the automatic order confirmation that we will send you additionally by e-mail after completing your order to the e-mail address you provided. This order confirmation e-mail contains the data of your order and our terms and conditions and can be easily printed out or saved with your e-mail program.
10.6 The European Commission provides a platform for online dispute resolution, which you can find under the link to the European Commission's platform (https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage). We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
